<p>Clerk S Stanton read the letter from fire Chief Sullivan.  Chief Sullivan is having an issue with the trailer park manager telling him they can not use the hydrant in front of the park.  Board members state if there is a fire Chief Sullivan has the right to use any hydrant he deems necessary.  The  board wants Clerk S Stanton to send a letter to park manager and a copy to Chief Sullivan.  CEO Lewis has not been receiving calls due to Chief Sullivan calling the wrong number.  CEO Lewis gives her correct cell phone number to the board and the Clerk to forward onto Chief Sullivan.</p>

<p><strong>Trustee Hurd makes the motion to take $478.25 from the emergency fire department fund to pay Donavan’s for the rescue truck that needed a fuel line replaced. </strong></p>

<p><strong>Mayor Coles makes the motion to send “Permission to Inspect Property” forms to the property owners that are involved in the White Hallow Run project with a letter explaining the project again and what the form is for along with a pre-stamped/addressed envelope for the forms to be returned.</strong></p>

<p><strong>Mayor Coles makes the motion to pay the General claims, #418 – 423, 425-428, 431-435, 444-445, 447-448 totaling $18,718.83.</strong></p>

<p>The CHIPS money was received from the State in the amount of $7,662.30 for the sidewalks completed during the 2010-2011 fiscal year.</p>
<p> </p>
<p>A resident called the office and asked if the Village had any plans of reseeding the area around the sidewalks.  Mayor Coles says the area will be reseeded, we just had to wait for a time when the rain stopped.  Mayor Coles asks Clerk S Stanton to contact Fred Roberts and ask if he could reseed the areas around the installed sidewalks.</p>
<p> </p>
<p>Clerk S Stanton has been speaking with the ARC Home and Mr. Robinson on the park committee in regards to flowers, potting soil, and mulch for the park this spring.  Mr. Robinson would like to use the Village credit card to purchase the supplies needed at Lowe’s along with a board member who can sign the credit card.  Clerk S Stanton is to contact Mr. Robinson and get a date that he would be available to go to Lowe’s and get the supplies.</p>
<p> </p>
<p><strong>Trustee Hurd makes the motion to rollover the Fire Truck CD for another 12 months that is up for renewal.</strong></p>
<p><strong>            Mayor Coles seconds the motion.    Favor 2 Opposed 0.    Motion was carried.</strong></p>
<p><strong> </strong></p>
<p>The floor is opened to the public.</p>
<p> </p>
<p>-Mrs. Bailey asks about the $46,000 that was not received from the town of Ashland for the Truck Fund in the 2006-2007 fiscal year until this year.  She wants to be sure this amount was put back into the General Fund and that there was not $20,000 of the taxpayer’s money put into the truck fund in 2006-2007 and then another $20,000 that was supposed to come from the fire contract in that year put into it again.  She also wants to know who caught the mistake and why it was not caught in an audit.</p>
<p>            Mayor Coles states that there was not a deposit into the truck fund in the year that the fire contract money was not received, that is why we put the $40,000 into the fund this year.  $20,000 was from the 2006-2007 fiscal year and $20,000 was from the current year.  It is in the contract between the Town of Ashland and the Village of Wellsburg that $20,000 of the amount given to the Village will go into a truck fund.  He also states he does not know why the mistake was not caught during an audit.  He states that this is one of the reasons that the Village Clerks have implemented new policies and procedures in regards to keeping track of revenues that are expected to come in and expenditures that are supposed to be going out.</p>
<p>- Mrs. Bailey would like to know if there is a policy in place that prevents the Clerk from leaving her position after the Village has sent her to classes to increase her knowledge of accounting. </p>
<p>            Mayor Coles states that there are no policies in regards to this in place.</p>
<p>-CEO Debbie Lewis would like to know where the money is coming from to fix the sidewalks if we are not getting enough from CHIPS. </p>
<p>            Mayo Coles states that we are budgeting to do the sidewalks and the streets throughout the next few years.  The CHIPS is just to offset the costs of the projects done.</p>
<p>-CEO Lewis also believes it would be more cost effective to go door to door to have the “Permission to Inspect Property” signed rather than spending the money to mail the letters.</p>
<p>            Mayor Coles says he agrees with this idea.</p>
<p>- Mr. Lewis would like to know if they can use the cement blocks in the ball field to stabilize their crick bank to prevent them from losing anymore land.</p>
<p>            Mayor Coles would like Clerk S Stanton to set up a meeting with Mark Watts and ask about a permit, Fred Roberts, Andy Avery with Chemung County, and our Chemung County legislature to attempt to fix the problem.</p>
<p> </p>
<p>CEO Lewis would like everyone to know it is legal to pump water from their cellars into the drywells as long as it is stormwater and does not have chlorine or contaminants in it.</p>
<p> </p>

<p>The park committee would like to request the water hooked up at the park pump house.  Mayor Coles says it will be done within the week.</p>

<p><strong>Trustee Hurd makes the motion to transfer $16,000 from to transmission savings account to the transmission CD.</strong></p>

<p>Trustee Hurd would like to know how much water was taken out of the hydrants by the county. </p>
<p>            Mayor Coles states that the water was not metered, the water was given to County for a shared services because they were cleaning the Village Streets with it. </p>
<p>Trustee Hurd states that they water should be metered.</p>
<p>-Mrs. Bailey asks if there is still a leak within the Village.</p>
<p>            Mayor Coles states that it is believed to be a calibration problem between the meters and it is being looked into.</p>
<p>-Mr. Burdick would like to know why the water cannot be taken from the crick?</p>
<p>            Mayor Coles states it probably could have been but it was more convenient to take the water from the hydrants and they were doing a service for the Village.</p>
<p>-Mrs. Bailey would like to know what the status is of the payment from the company that took water from the hydrants that was working on the highway, and why the Village did not call the police if a company left the area without paying their water bill to the Village.</p>
<p>            Mayor Coles states that we are waiting for the water company to return to the area to collect.</p>
<p>-Mrs. Bailey would like to know why the prices have not been updated in the water book, she would also like to add that at the previous water meeting it was put in the minutes that Mayor Coles made a comment about no one being “exempt” from paying a water bill.  She would like it known that nobody at that meeting had asked to be exempt from they payments but would like to look for a different way of charging the residents.</p>
<p>She would like to know why the decision was made to give water to the county and the company working on the highway without the rest of the board?</p>
<p>-Debbie Lewis would like to know if meters are read by the gallon why are we not getting billed by the gallon? </p>
<p>            Mayor Coles states that it was figured out, when the price was raised to $42 per month per unit, that the Village needed that amount of income to pay the debt service and run the water department. </p>
<p>-Rick Comstock would like to know what has to be done to look for an alternative way to bill?  He also would like to know why the board does not have a set of bylaws to go by.</p>
<p>            Mayor Coles states that the Water Board governs itself.</p>
<p>-Mrs. Bailey would like to know about the meters and why we purchased 145 of them when previously we had been buying 20-25 every year?</p>
<p>            Mayor Coles states that we borrowed the money to replace all of the meters in the Village that were the “touch reads” (the old style meters) for the “radio reads” (the new style meters that are read remotely).  He states this will help us to keep better control of our water. </p>
<p>- Mrs. Bailey wants to know how much the loan was for</p>
<p>            &#8211; Mayor Coles states that it was for $30,000.</p>
<p>-Mr. Maccoy would like to know how the Village can get a loan that he has to pay back when he does not have a meter.</p>
<p>- Mrs. Bailey would like to know why the people who are getting shut off not getting a $15 charge.</p>
<p><strong> </strong></p>
<p><strong>Trustee Hurd makes a motion to table the question of the individuals shut off getting a $15 monthly charge until they are turned back on.</strong></p>
<p><strong>            Trustee Coles seconds the motion.   Favor 2 Opposed 0.    Motion was carried.</strong></p>

<p>- Mrs. Bailey states the shut off list may be so great because people can not afford the bill.</p>
<p>            Mayor Coles states that he will no longer be giving anything away.</p>
<p>-Mr. Bailey states he would like to see a different approach to the water department.</p>
<p><strong>-</strong> Mrs. Morris states that if trustees do not show up to the board meetings they should remove themselves from the board. ****  Trustee Stanton was not available to come to the meeting due to a family emergency she was dealing with****</p>

<p><span style="text-decoration: underline;">Budget Public Hearing</span></p>
<p><span style="text-decoration: underline;"> </span></p>
<p>A.3497 – Fire Protection, Equipment, and Capital Outlay. – New item for savings account for firemen’s new bulk equipment.</p>
<p> </p>
<p>Trustee Hurd is not happy with the budget, suggests bonding for the fourth street project of redoing to road.  He is not have happy with such a big increase in taxes. </p>
<p>Mayor Coles states that if we go for a bond all of the Village streets that need to be repaired need to be done rather than getting a bond for only fourth street when that is already allocated in the budget.  These streets include, Church Street, Fifth Street, Fourth Street, Third Street, and the 1<sup>st</sup> Street Alley are the ones known but an inventory of the streets would have to be completed first.</p>
<p>Trustee Stanton and Trustee Hurd agree to this. </p>
<p>Mayor Coles states that we do not have enough time before the budget is due to get quotes and the bond approved. </p>
<p>Attorney Barnstead states that it would take at the very least 3 months to get approved for a bond. </p>
<p>Trustee Stanton states that we allocated enough money to complete fourth street and do enough of Church Street to fix the problem area and we can work on a bond this year. </p>
<p>Mayor Coles states the only way he can see lowering the taxes is taking more money from the reserve. </p>
<p>Trustee Stanton states she would not be comfortable taking more money out of the reserve without an agreement and plan to replenish it this year.</p>
<p>Mayor Coles and Trustee Hurd agree to this.  They decide to take $10,00 from Reserve to decrease the taxes.</p>
<p>This brings the tax rate to $306.24 per thousand assessed value and $93,718.63 in taxes to be raised.  This is an increase of $24.98 per thousand from last year. </p>

The Village Board recommends removal from membership but stresses that they can only make a recommendation, it is ultimately the fire commissioners decision.</p>

<p>Commissioner Coles states that there is a water pipe in the pole barn in back of the f.d. Mayor Coles states that it should be moved to the pump house on Church St.. Commissioner  Coles will get in touch with Fred Roberts to schedule it being relocated.</p>

<p>Commissioner Coles states that the siren in front of the f.d. is not working. The office is to contact Bob Beckwith to look at it.</p>

<p>* Mr Faucett states that there are two furnaces in the home, he then shows the board a video showing that his home is not separated into two separate units and that their family lives in the entire house.</p>
<p>            -Mayor Coles states he could not see a kitchen in the video.</p>
<p>* Mr. Faucett states there is a kitchen at the bottom of the stairs and at the top of the stairs.</p>
<p>            -Mayor Coles states that because there are two kitchens that is considered a “multi-dwelling home”</p>
<p>* Mr. Faucett states that he will get a lawyer and fight the bill and will not pay the extra $42.</p>
<p>            &#8211; Mayor Coles states that is fine and if the bill is not paid the water will be turned off.</p>
<p>* Mrs. Bailey asks if the board has considered going to usage rather than a flat rate.</p>
<p>            &#8211; Mayor Coles states that even people who own houses on their own in the Village are paying the $42 per month, therefore someone renting on their own should not be exempt from that.</p>
<p>* Mike Maccoy would like to know why we are paying so much?  He would like to know if we are behind in the bills we have or if we are in the red and if that is the motivation for the board charging apartment owners.</p>
<p>            &#8211; Mayor Coles states that we had a major leak that previous year that depleted our        reserve fund.  We have to be able to make up for that and with the debt service and bills that must be paid we have to have a way to come up with that money.  We do not have enough water customers to spread the money out.</p>
<p>* Mr. Bailey asks if it would be possible to raise every water customer a few dollars.</p>
<p>            &#8211; Mayor Coles states that is not something they are looking into.</p>
<p>*Mr. Bailey asks if the water bill will go down when the Village is caught up?</p>
<p>            &#8211; Mayor Coles states that until more water customers hook up on Maple Avenue to spread out the debt service the cost of water will only go up.</p>
<p>* Mike Maccoy states there is no incentive to hook up to the Village Water for these residents.</p>
<p>            &#8211; Mayor Coles states that with the wells on Maple Avenue and the health department starting to get involved there will be more hook ups.</p>

<p>Dan from Teledair explains the issues with the phones and that all of them have been fixed other than certain individuals not being able to call in.  He explained that this issue is not an issue with their phone system, it is an issue with Time Warner Cable and Verizon that is currently being worked on.  Dan states that all service calls that were charged to the Village to fix the ongoing issues will be refunded by Teledair.</p>
<p><strong>Trustee Coughlin makes the motion to stay with Teledair as the Village of Wellsburg’s phone service provider.</strong></p>

<p>F.D. Report – Mayor Coles received a call from the auxillary for a meeting on September 27<sup>th</sup> 2010 at the Fire Station.  They asked for the Village to be a mediator at a meeting between the Fire Department and the Auxillary to resolve issues involving the two parties.  The meeting is scheduled for Fri October 29<sup>th</sup> at 5 PM.</p>
<p> </p>
<p>Clerk Stanton gives the board the numbers for the calls in the past 2 years that were requested at the last board meeting.</p>
<p> </p>
<p>MS4 Report – Need to contact Mark Watts to get an idea of when the White Hallow Run Project will begin and how long it will take. </p>
<p> </p>
<p>Court Report – 2 criminal cases completed, 36 V&amp;T Tickets completed, 0 Civil Cases pending or completed totaling 38 cases with $3,805.00 in fines, bail, forfeitures, and fees collected.</p>
<p> </p>
<p><strong>Mayor Coles makes the motion to pay the payroll for September totaling $1,987.39.</strong></p>

<p>Final Audit Report from Duane Shoen is presented to the board.  Potential issues with the audit are brought about.  The AUD that was used to complete the audit was incorrect.  Professional Accounting had incorrect figures on the AUD that was presented the Mr. Shoen, the final AUD was not turned in until April of 2010 and the only changes stated that the auditor would fix any journal entries.  Clerk Stanton is to get ahold of Mr. Shoen to find out where we go from here and what has to be changed.</p>
<p> </p>
<p>Street Maintenance Breakdown – After all figures are accounted for $3,279.09 is left over in the street maintenance budget.  Mayor Coles explains to the residents that the board would like to have sidewalks replaced on at least one side of every street in the Village within 5 years.</p>

<p><strong>Mayor Coles makes the motion to provide $1000 worth of fuel to the Town of Ashland Highway Dept from Coldiron Fuel.</strong></p>

<p>Appraisal for Pratt Property was ordered by Elmira Savings Bank.  They also required a copy of the Purchase Agreement between the Village and the Pratts.</p>

<p>Water Report – There is still an overage of the amount of water E.W.B is billing the Village compared to the amount of water the Village is reading every month.  The only explanation of this is that there is an issue in the Maple Avenue line OR the meters for Elmira Water Board and the Village Meters are not calibrated correctly.  The Village meter is showing 160,150 gallons less than what the E.W.B meter is showing.  Clerk Stanton is to contact E.W.B and have them open up their meter pit while we have our pump house and the houses on Maple Avenue shut off to see if the meter is still spinning.  If it is, then there is a leak on Maple Avenue and Rural Water will have to be brought in for leak detection services.</p>

<p>Mayor Coles opens the floor for the multi-consumer dwelling discussion.</p>
<p>            Mrs. Rathbun asks why the apartment owners cannot get separate meters for each apartment</p>
<p>Mayor Coles states they can but they must be paid for by the home owner.</p>
<p>            Mrs. Rathbun would like to know why the Village would not pay for the meters?</p>
<p>Mayor Coles explains that is the way the rules are set up in the rules/regs book.  The Village only replaces meters or puts in the meter for a new home being added to the system.</p>
<p>He also states the water department is self funded, the tax payers do not pay for this.</p>
<p>            Mr. Comstock would like to know why the usage is not billed by the gallon rather than given a flat rate. </p>
<p>Mayor Coles states this is the only fair way to do it.  With the debt service we have, we have to be sure we have a stable income every month/year to be able to pay the bills. </p>
<p>            Mr. Comstock wants to know if we have a reserve.</p>
<p>Mayor Coles states we are breaking even with a small reserve.</p>
<p>            Mrs. Rathbun wants to know if the residents have a vote in the matter.</p>
<p>Mayor Coles states that they do not, the Village residents voted for the board members to make their decisions and that is what they are doing.</p>
<p>            Mr. MacCoy would like to know why the Village pays so much more than the City of Elmira.</p>
<p>Mayor Coles states that we have a debt service to pay on top of what Elmira Water Board charges the Village for the water to be delivered.</p>
<p>            Mr. Comstock asks if the board would consider figuring out how much the Village uses and charge by the gallon accordingly.</p>
<p>            Mrs. Martin would like to know about what to do about apartments that are vacant?</p>
<p>Mayor Coles states that for those owners to call the Village Office and set up an appointment for a board member to come and inspect the dwelling to be sure it is vacant and the bill will be adjusted appropriately.</p>
<p>            Mr. Comstock suggests charging by the gallon with an upcharge and service charge for having the maintenance and service or the Village pays for the residents to have a new meter put on the house.</p>
<p>Trustee Coughlin states that they could possibly look into a different billing method.</p>
<p>            Mrs. Bailey would like to know if the board would entertain changing the billing system and an amendment to the rules/regulations,</p>
<p>Mayor Coles says the board will look into it.</p>
<p>            Mr. MacCoy would like to know how much a meter is.</p>
<p>Mayor Coles states the meters are $173 a piece but if putting in a meter pit the total would be roughly $500.</p>
<p>Mayor Coles states he does not want to make a decision without Trustee Stanton present.</p>
<p>Attorney Barnstead says the Village Board can run the water department as they see fit.  They do not have to run by the public service commission.</p>
<p>Residents want to know if a special meeting can be scheduled.</p>
<p>Mayor Coles states for Clerks to get ahold of Trustee Stanton and schedule a water information meeting after October 18<sup>th</sup>.</p>

<p>Shut off Notices – Last Day to Pay – Mon. October 25<sup>th</sup>          Date of shut off – Tues. Oct. 26<sup>th</sup> </p>
<p>Clerk Stanton is to look into a “Bill Enclosed” Stamp for the water bills and tax bills.</p>
<p>Clerks are to be sure to highlight the overdue bill message on the bills every other month to be sure the residents are seeing it.</p>

<p><strong>Mayor Coles makes the motion to allow Water Operator Mike Steck to order parts through the Village as long as the Purchase Order Numbers can be distinguished.</strong></p>

<p><strong>Trustee Coughlin makes the motion to pay the bill for the Village Office sign printed to go at the entrance of the building.</strong></p>

<p><strong>Trustee Stanton opposed the motion due to one part of the bill stating $60 owed while another part states $100 owed.  She would like to know what the final price of the sign is before approving.</strong></p>
<p><strong>            **The final price is $60.  The price on the bottom of the bill looks like $100 however it is just bad handwriting that ran together. **</strong></p>
<p><strong> </strong></p>
<p><strong>Mayor Coles makes the motion to organize a fall clean up with the Town of Ashland on Saturday October 23<sup>rd</sup> from 8 am – 5 pm and Sunday October 24<sup>th</sup> from 10 am – 2 pm.  The cost of a permit for the clean up will be $20 per household until October 7<sup>th</sup> at which point the price goes to $30 per household.</strong></p>

<p>No businesses will be allowed to be involved in this clean up.  The Clerks are to get a letter out to the residents right away.</p>

<p><strong>Mayor Coles makes the motion to accept the financial statements of the Village of Wellsburg Court as provided by Court Clerk Kimberly Tuttle.</strong></p>

<p><strong>Trustee Stanton makes the motion to purchase $500 worth of concrete blocks, which will be monitored by cameras, that will allow residents to dump brush/debris and then will be disposed of at the spring and fall clean ups.</strong></p>
<p><strong>            Trustee Coughlin seconds the motion.          Favor 3 Opposed 0     Motion was carried.</strong></p>
<p><strong> </strong></p>
<p>- The Village phone service has been continually having issues with the voicemail and certain individuals not being able to get through to the office.  The phone just rings rather than the system picking up.  Ted Darrow from Teledair came to the office numerous times without resolving the issues, he also had Clerk Peck trying to fix issues over the phone that did not solve the problems.  Kim Tuttle from the Town of Ashland was contacted by Ted and he informed her that the Village would need a new “service box.”  Dan Darrow from Teledair came to the office and finally fixed all of the issues accept for certain individuals not being able to get through.  The board decides to give Teledair until the end of September to meet their demands:</p>
<p>            &#8211; Putting a new service box in at no cost to the Village of Wellsberg      </p>
<p>            &#8211; Any and all service calls will be refunded</p>
<p>            &#8211; Verify the panic button will still be able to be used with the new service box</p>
<p>            &#8211; Allow all calls to come through to the Village.</p>
<p> </p>
<p>- Town of Ashland/Town of Elmira fire contracts.</p>
<p>            &#8211; $15,000 Town of Elmira</p>
<p>            &#8211; $$57,966 Town of Ashland with $20,000 to the New Truck Fund</p>
<p>Trustee Coughlin requests a breakdown of the Fire Department calls for the year.</p>
<p>Numbers are to be provided to the board and then a special meeting is to be called.</p>

<p> - The Clerks are to have all board members sign the letters and send them out with the first 5 pages of the water rules book.</p>

<p>- Total of 15 home owners will receive the letter</p>
<p>- The board requests that the letter have all questions addressed to the board members rather than the Clerks.</p>

<p>The board requests a letter written to residents on Maple Avenue to make them aware of the fact that they have the option to hook to the Village water line.</p>

<p>Mayor Coles is in the process of getting keys made for the board members as soon as he has verified which keys go to where.</p>

<p>Mayor Coles requests the board go through the pump house to determine what should be kept and what should be thrown away, along with getting an idea of what we have for inventory.</p>

<p>Attorney Barnstead is going to work on a shared service agreement between the Village of Wellsburg and the Town of Ashland which will cover all manpower, equipment, and shared services required.</p>
<p> </p>
<p>Mayor Coles would like the board to meet with Tim Steed and go over any grant prospects he may be able to help the Village with in the water department.  Hydrants and meters need to be replaced and any residents that are looking to hook up to Village Water will cost the Village money.</p>
